§ 2. Subject matter and scope of the Company's services
- In the Service the Company provides:
- free of charge: access to news (headline, short teaser and a link to the publisher), the regulatory map, the Equipment Catalogue, the public part of the Patient Zone, the Diary, the list of medicinal products authorised in Poland, the doctor and clinic finder, module 1 of the course for growers and of the course for patients, and the Account;
- for a fee: Support, giving access to the Supporters' Zone, on the terms set out in § 2a.
- The User acquires online access to Supporters' Zone Content within the chosen Plan. The User does not acquire ownership of the Content, and the contract transfers no economic copyright in the Content or the Company's databases.
- The Service is informational and educational. The Company:
- gives no medical, legal or tax advice;
- does not sell medicinal products, narcotic drugs, psychotropic substances, cannabis seeds or flower;
- does not advertise medicinal products.
Detailed disclaimers on medical, educational and cultivation Content are set out in § 9.
- In the Equipment Catalogue the Company acts solely as an intermediary that presents offers and forwards orders to Partner Shops. The Company is not a party to the sale of goods (§ 8).
- Functions marked in the Service as planned, announced or available from a future date are not part of the contract until the Company makes them available. The dates given are for information only. The Company will state the financial terms of such a function separately.
- The Company's liability under a Support contract relates solely to providing access to the Content within the chosen Plan, subject to § 12.
§ 2a. Purpose of the Service and nature of the Support
- The Service is run for an educational purpose: spreading scientific knowledge about the medicinal properties of cannabis and about the physiology and biology of the plant, based on the published sources cited with the Content. It is intended for Healthcare Professionals, patients and their families, and people interested in the subject, including — only with regard to legal systems in which it is permitted — people who grow the plant (§ 9(7)).
- The Company uses the payments for Support to maintain and develop the Service and its educational Content, in particular to acquire and process scientific sources, pay for Expert reviews, develop the Knowledge Base, Digital Plant and the Academy, and run the technical infrastructure. For this reason paid access is called "Support" in the Service, and the Users who have it are called "supporters".
- Whatever name is used in the Service, Support is a paid contract for the supply of digital content and digital services, and its price is the remuneration for access to the Supporters' Zone within the chosen Plan. Support is not a donation, a public collection or a payment for a public-benefit purpose, and the Company is not a public-benefit organisation. Paying the price does not entitle anyone to the tax reliefs or deductions provided for donations. The price includes VAT, and the Company issues documents in accordance with § 6(6).
- A User who is a Consumer has all the rights provided by these Terms and by law in connection with the Support, in particular the right of withdrawal (§ 13), the rights in the event of a lack of conformity of digital content or a digital service with the contract (§ 12(7)) and the right to file a complaint (§ 16).
- Substantive Content does not depend on who pays for Support. The Company accepts no payments or other benefits conditional on Content being published, changed or left out. [FOR THE OWNER TO DECIDE: The Company accepts no funding from entities that manufacture or market medicinal products containing cannabis.]
- The Company does not conduct scientific research involving Users or using their data. Concluding a Support contract does not mean consent to any of the User's data being used for research. If the Company intends to conduct or support such research in the future, it will first publish separate information about its purpose, scope, the entities involved and the safeguards. Taking part will require a separate, voluntary consent, and not giving it will not affect the use of the Service (Privacy Policy § 4(6)).
§ 2b. Development support
- Apart from Support, a User may make a voluntary payment for the development of the Service in an amount of their choice, not lower than the one stated in the Price List ("Development Support").
- Development Support gives no access to the Supporters' Zone or to any other paid Content or functions. Its only effect in the Service is a crown symbol marking the Account, visible to the User in their Account; the Company publishes neither amounts nor a list of supporters.
- The Company uses Development Support payments for the purposes set out in § 2a(2), including further work on scientific sources. [FOR THE LAWYER AND THE ACCOUNTANT TO DECIDE: the legal nature of the payment (donation or paid service), VAT, the type of document.]
- Development Support is a one-off payment and does not renew. The Company e-mails a payment confirmation to the address linked to the Account.
§ 3. Technical requirements and the User Environment
- Using the Service requires:
- a device with a current operating system and a current browser (Google Chrome, Microsoft Edge, Mozilla Firefox or Apple Safari, current or previous major version);
- an internet connection;
- JavaScript, the cookies necessary for the Service and browser local storage enabled;
- for an Account, an active e-mail address.
The 3D functions (Digital Plant) need a browser supporting WebGL or WebGPU.
- The User is solely responsible for choosing, configuring, securing and maintaining the User Environment. The Company is not responsible for whether the User has hardware, software or a connection that allows use of the Service, nor for how the Service works on the User's hardware and alongside other software the User has installed.
- Before placing an Order the User should check the User Environment against the technical requirements. The free part of the Service, including module 1 of the course for growers and of the course for patients, allows the Content to be assessed before purchase.
- A Consumer is informed before the contract that, where the cause of a lack of conformity of digital content or a digital service is unclear, they must cooperate with the Company to a reasonable extent and by the least burdensome technical means. The purpose is to determine whether the lack of conformity results from the Consumer's digital environment. If the Consumer fails to cooperate, the presumptions as to the existence of the lack of conformity at the relevant time do not apply.
§ 4. Account, Profile and roles
- An Account is free. The Account contract is concluded for an indefinite period when the e-mail address is confirmed. Users sign in with their e-mail address (password or one-time link) or, where the Service allows it, through their Google or Apple account.
- On the first visit the User chooses a Profile. The Profile determines the portal and Content shown and can be changed in the Account settings.
- Content intended only for persons authorised to prescribe or supply medicinal products is available to Healthcare Professionals. Verification consists of:
- checking the licence number given by the User against the public register;
- where that is not possible, confirmation by the Company.
Giving false data is a material breach of the Terms.
- Only the Company grants the Expert, Author and administrator roles, and every grant is logged. Two-factor authentication is mandatory for Experts and administrators and optional for other Users.
- The User keeps their login data confidential and is responsible for the actions of anyone they share it with. The Account is personal and may not be shared.
- Until the public launch of the Service, Accounts are created by the Company's invitation only.
§ 5. Concluding a Support contract
- Information about Plans and the Price List in the Service is an invitation to conclude a contract, not an offer within the meaning of the Civil Code. A contract may be concluded only online, through the Service, in Polish [or English].
- Placing an Order consists of, in this order:
- choosing a Plan;
- choosing the currency and payment method;
- giving the data needed to conclude the contract and issue a sales document (for a Trader, also the company name and NIP);
- making the statements required by the Terms and the law.
- Directly above the button that finalises the Order, the Service shows clearly and visibly:
- the name of the Plan;
- the total price including VAT;
- that the purchase is paid online access to the Supporters' Zone, not a donation (§ 2a(3));
- the billing period, whether the Support renews automatically and how to cancel;
- the right of withdrawal and the circumstances in which it is lost.
- The button that finalises the Order is labelled "ORDER WITH OBLIGATION TO PAY" ("ZAMAWIAM Z OBOWIĄZKIEM ZAPŁATY"). Clicking it means the User knows that they are buying online access to the Supporters' Zone within the chosen Plan and undertakes to pay the price.
- The User may place an Order only after reading the Terms and the Privacy Policy, which are linked directly next to the Order form. Clicking "Order with obligation to pay" means that the User has read and accepts the Terms and the Privacy Policy and confirms that the data in the Order is true.
- Consents and statements that by law require a separate, active action are given by ticking separate boxes that are not pre-ticked. These include in particular:
- the request to open the Supporters' Zone before the withdrawal period ends, together with the acknowledgement of the effects of withdrawal (§ 13);
- consent to recurring payments;
- marketing consents.
Marketing consents are voluntary, and refusing them does not affect the contract.
- The contract is concluded when the payment operator confirms the payment. The Company e-mails a confirmation of the contract, including the statements made, to the address linked to the Account. The Company may refuse an Order for important reasons, in particular incomplete or false data or a justified suspicion of abuse. It informs the User of a refusal without delay and refunds any payment made.
- The Company makes the ordered Content available immediately after the contract is concluded, subject to § 13(5).
§ 6. Prices and payments
- Prices in the Price List are gross and include VAT. The currency follows the phone number linked to the Account: with a +48 number prices and payments are in Polish zloty, with any other number in euro. The Company keeps only the calling code and a hash of the number. A +48 number may need confirmation by an SMS code.
- The price in the Price List at the time of the Order applies. Changes to the Price List do not affect contracts already concluded, subject to paragraph 5.
- Payments are processed by:
- PayPro S.A. (Przelewy24), for PLN;
- Stripe Payments Europe Ltd., for EUR.
The payment date is the date the operator confirms the payment. The Company does not process card data.
- Support is paid in advance. The User may pay for 1 to 120 months at once; the number of months is the chosen amount divided by the Plan's monthly price, rounded down. Support paid for more than one month does not renew automatically. When one month is paid:
- for PLN payments, each period is paid separately. Support does not renew automatically, and the Company sends a reminder 3 days before the paid period ends;
- for EUR payments, Support renews automatically for further monthly periods, based on consent to recurring payments given in the Order. The User may cancel renewal at any time in the Account settings, effective at the end of the current billing period, without giving reasons.
- The Company announces a price change for automatically renewing Support by e-mail at least 30 days in advance. The change applies to periods starting after it takes effect. Until then the User may cancel renewal at no cost.
- VAT invoices are issued electronically and sent to the National e-Invoice System (KSeF) where the User gives a NIP in the Order. Otherwise the Company issues a payment confirmation. Documents are available in the Account. The User consents to receiving documents electronically, and a Consumer may withdraw this consent at any time.
- Promo codes and free access granted by the Company are personal, single-use and valid for the period stated when granted. They cannot be exchanged for money. Whenever a price reduction is announced, the Company states the lowest price applied in the 30 days before the reduction.
- The User bears their own costs of third-party services, including payment operators and internet providers.
§ 7. Access to Content, availability and changes
- The Company grants the User a non-exclusive, non-transferable licence to use the Supporters' Zone Content within the Support. The licence runs for the duration of the Support. It covers personal use only, without the right to sublicense; for Healthcare Professionals it also covers use in their professional practice. The User may not share the Content with third parties or offer it to them, whether for payment or free of charge.
- The Company makes efforts to keep the Service continuously available. Access may be temporarily limited or interrupted because of:
- maintenance, updates or failures;
- force majeure;
- events beyond the Company's control (including failures of networks, connections and third-party services);
- attacks by third parties.
Where possible, the Company announces planned maintenance in the Service or by e-mail and schedules it at the least disruptive times.
- The Company may introduce changes and updates to the Service, including security updates, bug fixes and legal-compliance changes. It informs Consumers of updates, including security updates, needed to keep digital content or services in conformity with the contract.
- The Company may change Content or functionality other than to keep it in conformity only for important reasons. Important reasons are:
- changes in law or in the requirements of authorities or third parties;
- updates in scientific knowledge and Experts' recommendations;
- security;
- technological development;
- withdrawal by a supplier of technology used in the Service;
- the need to fix errors;
- improvement of the Service.
If a change significantly and negatively affects a Consumer's access to or use of the Content, the Company informs them reasonably in advance. The Consumer may then terminate the contract without notice under the applicable law.
- Scientific and medical Content is updated as knowledge develops. New Courses and functions made available in the Supporters' Zone are included in the Support at no extra charge. The Company is not obliged to keep earlier versions of Content.
- Functions that work with third-party services depend on those third parties' operation, terms, availability and changes. This covers in particular:
- Przelewy24 and Stripe payments;
- e-mail;
- Google or Apple sign-in;
- public registers, such as the URPL, RPWDL and NIL registers, and KSeF;
- publishers' and Partner Shops' websites.
The Company has no influence over them and is not liable for their operation, changes, suspension or discontinuation, or their consequences.
- Naming publishers, shops, producers, doctors, clinics or others in the Service is for information only. It is not a recommendation or a guarantee of their services or goods.
§ 8. Equipment Catalogue and orders with Partner Shops
- The Equipment Catalogue presents offers published by online shops, with a price comparison.
- Prices and availability come from the shops' websites and may be out of date. The shop's price and terms at the time of ordering are binding.
- The "fair price" shown in the Catalogue is a statistical estimate, not an offer or a recommendation.
- By default, offers are ranked by unit price and relevance to the query. The main ranking parameters are described in the Service. Paid placements, if introduced, will be clearly labelled. Each offer shows the shop and whether it is a trader.
- With a Partner Shop, the User may order through the Service:
- the cart is split into separate orders, one per Partner Shop;
- the sales contract is concluded directly between the User and the Partner Shop, under the Partner Shop's terms, which are linked before the order is placed;
- payment is made directly to the Partner Shop through its Przelewy24 account. The Company does not receive, hold or transfer funds due to the Partner Shop;
- the Company forwards to the Partner Shop the data needed to fulfil the order and informs the User of the order status reported by the Partner Shop.
- Only the Partner Shop is responsible for:
- the goods and their delivery;
- conformity with the contract;
- withdrawal from the sales contract;
- sales documents.
Complaints about goods go to the Partner Shop. Where reasonable, the Company will pass on a notice received from the User.
- The Company's remuneration from a Partner Shop results from a separate agreement and does not increase the price paid by the User.
- The Equipment Catalogue does not include seeds of non-fibre cannabis or goods whose sale is prohibited in Poland.
§ 9. Medical, educational and cultivation Content
- Content is informational and educational only. It is not medical advice, a diagnosis or a treatment recommendation, and does not replace a doctor or pharmacist. Users make treatment decisions with their doctor. In an emergency, call 112.
- Content for Healthcare Professionals is scientific and does not replace the Summary of Product Characteristics or current guidelines. Therapeutic decisions belong to the treating physician.
- In the Patient Zone the Company does not recommend specific products, brands or pharmacies and gives no individual doses.
- The Diary works by default only in the User's browser storage. Saving entries in the Account requires the User's explicit consent to the processing of health data. Withdrawing that consent, which is possible at any time, deletes the entries from the Account. The Company does not analyse entries or derive recommendations from them.
- The list of medicinal products is based on public-register data (in particular URPL and GIF) and is informational. It is not advertising of medicinal products or encouragement to use them.
- The doctor and clinic finder contains data from public registers, or data submitted and verified by the Company.
- The order of presentation is neutral.
- The Company publishes no ratings or rankings and accepts no payment for prominence.
- A person listed may request removal through the form in the Service.
- Cultivation Content is educational and refers to legal systems in which cultivation is permitted. Cultivating cannabis other than fibre hemp is prohibited in Poland. The User is responsible for complying with the law where they are. The Service does not encourage the use of narcotic drugs.
- Substantive Content is reviewed by Experts, and the review date is shown with it. A review does not mean that the Expert takes responsibility for the User's decisions.
- Detailed disclaimers, including on copyright, text and data mining and images, are published in the Service as the "Disclaimers" and form an integral part of the Terms.
§ 10. User content, Experts and Authors
- A User who posts content in the Service grants the Company a free, non-exclusive licence to display it in the Service, without territorial limits, for as long as it is published. This covers in particular finder submissions, feedback on Content and, once launched, product reviews. The User declares that they hold the rights to the content they post.
- Anyone may report content they consider unlawful via the "Report" link or at info@cannabis-institute.com.
- The Company handles reports without undue delay and informs the reporter and the author of its decision, with reasons.
- Decisions may be appealed at the same address.
- The point of contact for authorities and Users is info@cannabis-institute.com, in Polish or English.
- Product reviews, if launched, will be published with information on whether and how the Company ensures they come from people who used or bought the product. The Company does not publish paid reviews and does not remove negative reviews merely because they are negative.
- Experts and Authors cooperate with the Company under separate agreements. The Author and the reviewing Expert are credited with the Content. Experts have read-only access to the Company's non-public sources, without export, and every access is logged.
§ 11. User obligations and prohibitions
- The User undertakes to use the Service in accordance with the law, the Terms and good practice.
- In particular, the following are prohibited:
- supplying, storing or sending unlawful content, including:
- advertising of prescription medicines;
- offers to dispose of narcotic drugs or psychotropic substances;
- content promoting their use;
- third parties' health data;
- actions that disrupt the Service, circumvent security, test whether it can be broken, or overload the systems of the Company or third parties;
- automated harvesting of Content, including for text and data mining, in breach of the Company's reservations, robots.txt or § 9(9);
- copying, reselling, sharing or offering Supporters' Zone Content to third parties;
- removing the Company's marks, authorship notices and source credits;
- giving false data, in particular in Healthcare Professional verification.
- supplying, storing or sending unlawful content, including:
- The User is responsible for the actions of people using their Account. They are liable to the Company for damage resulting from breaches of paragraph 2, including third-party claims. To the extent the breach is on the User's side and their fault, the User undertakes to indemnify the Company against such claims.
- All rights to the Service, Content, databases, visualisations, marks and trademarks belong to the Company or to those from whom it obtained the relevant rights.
- The Company may temporarily suspend access to the Account or the Supporters' Zone where:
- the User breaches the Terms materially or persistently;
- the security of the Service requires it;
- a competent authority requests it.
It informs the User of the suspension and its reasons by e-mail, and restores access once the reason ceases.
§ 12. Scope of the Company's liability
- The Company is liable for non-performance or improper performance of the contract under the law, subject to this section. Paragraphs 3–6 apply only to Traders and do not limit Consumers' rights under mandatory law. No provision of the Terms excludes or limits liability towards a Consumer contrary to the Civil Code rules on abusive clauses.
- The scope of the Company's services (§§ 2, 8 and 9) and of the User's obligations, as set out in the Terms, defines the subject matter of the contract. It does not exclude the Company's liability for properly performing the services within that scope. The Company is not liable for events outside the scope of its services, in particular:
- Partner Shops' goods and services;
- health decisions taken without consulting a doctor;
- third-party websites reached through links;
- the events listed in § 3(2) and § 7(6).
- The Company is not liable to a Trader for damage caused by the User or by third parties for whom the Company is not legally responsible.
- The Company's liability to a Trader for non-performance or improper performance — whatever the legal basis — is limited to actual loss (excluding lost profits). It is also capped at the total price paid by the User in the 12 months before the event causing the damage.
- The limits in paragraph 4 do not apply to intentional damage or to other cases in which mandatory law excludes limitation of liability.
- The Company is not liable for non-performance or improper performance caused by force majeure. This includes in particular:
- failures of public telecommunications networks;
- cyber-attacks not resulting from the Company's culpable negligence;
- actions of public authorities;
- failures or changes at the third parties referred to in § 7(6).
- Towards a Consumer, the Company is liable for lack of conformity of digital content or a digital service under the Consumer Rights Act.
- This covers a lack of conformity that occurs or becomes apparent during the period in which, under the Support contract, the content or service was to be supplied.
- The Company is not liable to the extent the Consumer was expressly told, at the latest when the contract was concluded, that a specific feature departs from the conformity requirements.
§ 13. Withdrawal
- A Consumer generally has the right to withdraw from a distance contract within 14 days of its conclusion without giving reasons.
- The Consumer may make the withdrawal statement in any form, in particular by e-mail to info@cannabis-institute.com or in writing to the Company's registered office. The model in Annex 2 may be used but is not mandatory. Sending the statement before the deadline is enough.
- On withdrawal, the Company refunds the Consumer's payments without delay, and at the latest within 14 days of receiving the statement. It uses the same payment method, unless the Consumer expressly agrees to another.
- Starting the Support before the withdrawal period ends does not take away the Consumer's right of withdrawal. The effects of withdrawal are set out in paragraph 6.
- So that the Company can open the Supporters' Zone before the withdrawal period ends, the Consumer makes a separate, active statement in the Order: "I request that the supporters' zone be opened before the end of the withdrawal period. I acknowledge that if I withdraw I will pay for the period until withdrawal." Without this statement, the Company opens the Supporters' Zone after the withdrawal period ends.
- If the Consumer asked for the Support to start before the withdrawal period ended and then withdraws, they pay the Company an amount proportionate to what was supplied up to the withdrawal, based on the agreed price. After withdrawal the Company may prevent further use of the Supporters' Zone, and the Consumer stops using it.
- Traders have no statutory right of withdrawal.
- Withdrawal from a sales contract concluded with a Partner Shop follows that Partner Shop's terms (§ 8(4)).
§ 14. Termination
- The User may terminate the Account contract at any time by deleting the Account in its settings or by e-mail. Deleting the Account ends the Support at the end of the paid period. There is no refund of fees paid, except as provided in the Terms or by law.
- The Company may terminate the Account contract on 30 days' notice only for important reasons, in particular:
- the Company ceasing to run the Service;
- a material breach of the Terms despite a request to stop;
- false data;
- use of the Service that is unlawful or threatens system security.
- If the Company stops running the Service for reasons not attributable to the User, it refunds a Consumer the part of the Support price for the unused part of the billing period. The Company will announce its intention to cease operations in the Service and by e-mail at least 30 days in advance and will allow export of Diary data in that time.
- The Company may transfer its rights and obligations under the contract to a legal successor running the Service, after 14 days' notice by e-mail. For Consumers, the transfer is conditional on the acquirer taking over all of the Company's obligations. The Consumer may terminate the contract with effect on the transfer date and receive a proportionate refund for the unused period.
§ 15. Personal data
- The controller of the User's personal data is the Company. Contact: ul. Święty Marcin 29/8, 61-806 Poznań, Poland, e-mail: info@cannabis-institute.com.
- The Company processes the User's personal data for the following purposes:
- concluding and performing the contract, including the Account, access to Content, billing and support;
- tax and accounting obligations;
- establishing, pursuing and defending claims;
- security of the Service;
- with separate consent, marketing and keeping the Diary in the Account.
The respective legal bases are: necessity for the contract, legal obligation, the Company's legitimate interest and the User's consent. For health data, the basis is the User's explicit consent.
- Detailed information required by law (Arts. 13 and 14 GDPR) is in the Privacy Policy available in the Service. The User confirms acceptance of it when creating the Account and by clicking "Order with obligation to pay".
- Giving the data needed to conclude and perform the contract is voluntary but a condition of the contract. Consent to marketing and consent to the processing of health data in the Diary are voluntary and separate. Refusing them does not affect the contract or the use of other functions.
- For an order with a Partner Shop, the Company forwards to the Partner Shop the data needed to fulfil it. The Partner Shop processes the data as an independent controller under its own privacy policy.
- The Company applies technical and organisational measures appropriate to the risk, including specific safeguards for health data.
§ 16. Complaints
- Complaints about the Service or the Support may be made by e-mail to info@cannabis-institute.com or in writing to the registered office. A complaint should include:
- the User's details;
- a description of the problem;
- the date it occurred;
- the remedy expected.
The Company may ask for more information or for the cooperation described in § 3(4).
- The Company handles a complaint within 14 calendar days of receipt and replies to the e-mail address given in the complaint.
- If digital content or a digital service does not conform to the contract, the Consumer may demand that it be brought into conformity. The Company does so within a reasonable time and without undue inconvenience to the Consumer. It may refuse if this is impossible or would involve disproportionate costs. In the cases provided by law, the Consumer may declare a price reduction or withdraw from the contract.
- Complaints about goods bought from Partner Shops are handled by the Partner Shop (§ 8(4)).
- A Consumer may use out-of-court complaint and redress procedures, in particular mediation, an arbitration court or the district (municipal) consumer ombudsman. The Company is not obliged to take part in out-of-court proceedings and decides case by case. A list of consumer dispute resolution bodies is available on the European Commission website (https://consumer-redress.ec.europa.eu/dispute-resolution-bodies). The Company does not refer to the EU ODR platform, which ceased operating on 20 July 2025.
§ 17. Communication
- The Company and the User communicate by e-mail and through the Service. Company notices to all Users are published in the Service and deemed delivered on the day of publication. Such notices include information on maintenance, changes in functionality and Price List changes for new orders. They do not change contracts already concluded unless the Terms say otherwise.
- Individual Company statements to a specific User, such as confirmations, complaint responses, payment reminders and notices of termination, are sent to the e-mail address linked to the Account. They are deemed delivered when they reach that address in a way that allows the User to read them.
- The User sends statements and questions to info@cannabis-institute.com. A Consumer may also make statements and complaints in writing to the registered office.
- The User keeps an up-to-date, working e-mail address. The User bears the consequences of messages not received because of an outdated address or blocking on their side, including spam filters.
§ 18. Changes to the Terms
- The Company may change the Terms for important reasons:
- changes in law or case law affecting the Terms;
- changes in the Service's functionality or offer;
- security;
- changes in technical requirements;
- changes of operators or third parties;
- making the Terms clearer;
- removing any non-compliance with the law.
- The Company announces changes at least 14 days in advance by publishing the new text in the Service and e-mailing Users who have an Account. The change takes effect on the date stated. Until then the User may terminate a continuing contract (Account, Support) at no cost. If they do not, the change binds them from its effective date. For Consumers, changes may affect continuing contracts only as permitted by law.
- Contracts concluded before a change remain subject to the previous wording, unless:
- the change benefits the User;
- the change results from the law;
- the contract is a continuing one to which the new wording applies under paragraph 2.
§ 19. Governing law and disputes
- Polish law applies to contracts concluded under the Terms. This choice of law does not deprive a Consumer of the protection of the mandatory rules of their country of habitual residence.
- Disputes with Traders are settled by the common court with jurisdiction over the Company's registered office. Disputes with Consumers are settled by the courts with jurisdiction under general law.
- The parties try to settle disputes amicably, first by a complaint sent by e-mail.
§ 20. Final provisions
- The Terms are available in the Service and apply from 6 November 2026.
- Matters not covered by the Terms are governed by Polish law, in particular:
- the Civil Code;
- the Consumer Rights Act;
- the Act on electronically supplied services.
- The Terms are not intended to shape Consumers' rights and obligations contrary to good practice or in a way that grossly infringes their interests. If any provision is found not to bind a Consumer or to be invalid, the remaining provisions stay in force to the extent permitted by law. The provision concerned is replaced by the lawful provision closest to its economic purpose.
